What personal information do we collect about you?

We may collect personal information from you in the course of our business, including through your use of our website, when you contact or request information from us, when you engage our services or as a result of your relationship with one or more of our staff and clients.

Photography By Brenda Hudson collects and processes personal information about you in a number of ways, including through your use of our website and in the provision of services by us.  We use that information:

  • To provide and improve this website, including auditing and monitoring its use
  • To provide and improve our services to you and to our clients, including handling the personal information of others on behalf of our clients
  • To provide information requested by you
  • To promote our services, including sending offers and updates, publications and details of events
  • To manage and administer our relationship with you and our clients
  • To fulfil our legal, regulatory and risk management obligations, including establishing, exercising or defending legal claims
  • For the purposes of recruitment

Use of Nightingale Portraits website

A number of facilities on our website invite you to provide us with personal information, such as the contact page section of our website and our email queries facilities.  The purpose of these facilities is apparent at the point that you provide your personal information and we only use that information for those purposes.

Our website uses Google Analytics, a web-based analytics tool that tracks and reports on the manner in which the website is used to help us to improve it. Google Analytics does this by placing small text files called ‘cookies’ on your device. Marketing and other emails

We operate an email mailing list program, used to inform subscribers about products, services and/or news we supply/publish. Users can subscribe through an online automated process where they have given their explicit permission. Subscriber personal details are collected, processed, managed and stored in accordance with the regulations named in ‘The policy’ above. Subscribers can unsubscribe at any time through an automated online service, or if not available, other means as detailed in the footer of sent marketing messages (or unsubscribe from all Mailchimp lists). The type and content of marketing messages subscribers receive, and if it may contain third party content, is clearly outlined at the point of subscription.

Although we only look to include quality, safe and relevant external links, users are advised to adopt a policy of caution before clicking any external web links mentioned throughout this website.

 How long we keep your personal information

  • Your personal information will be retained in accordance with our global data retention policy which categorises all of the information held by Photography By Brenda Hudson and specifies the appropriate retention period for each category of data.  Those periods are based on the requirements of applicable data protection laws and the purpose for which the information is collected and used, taking into account legal and regulatory requirements to retain the information for a minimum period, limitation periods for taking legal action, good practice and Christina Hernandez business purposes.

Who we share your personal information with

We are a UK Based website and branding company and we operate within the UK as well as the EU and Globally and any information that you provide to us may be shared with and processed by any entity in the UK that is associated with Photography By Brenda Hudson and our associated firms.

We may also share your personal information with certain trusted third parties in accordance with contractual arrangements in place with them, including:

  • Our professional advisers and auditors
  • Suppliers to whom we outsource certain support services such as website hosting, backup and security, and admin
  • IT service providers to Nightingale Portraits

Where necessary, or for the reasons set out in this policy, personal information may also be shared with regulatory authorities, courts, tribunals, government agencies and law enforcement agencies.  While it is unlikely, we may be required to disclose your information to comply with legal or regulatory requirements. We will use reasonable endeavours to notify you before we do this, unless we are legally restricted from doing so.

If in the future we re-organise or transfer all or part of our business, we may need to transfer your information to new Christina Hernandez entities or to third parties through which the business of Nightingale Portraits will be carried out.

Nightingale Portraits may use social media sites such as Instagram, Facebook, LinkedIn, Pinterest and Twitter.  If you use these services, you should review their privacy policy for more information on how they deal with your personal information.

We do not sell, rent or otherwise make personal information commercially available to any third party, except with your prior permission.

Social Media Policy & Usage

We adopt a Social Media Policy to ensure our business and our staff conducts themselves accordingly online. While we may have official profiles on social media platforms users are advised to verify the authenticity of such profiles before engaging with, or sharing information with such profiles. We will never ask for user passwords or personal details on social media platforms. Users are advised to conduct themselves appropriately when engaging with us on social media.

There may be instances where our website features social sharing buttons, which help share web content directly from web pages to the respective social media platforms. You use social sharing buttons at your own discretion and accept that doing so may publish content to your social media profile feed or page. We will use your images on social media to promote our business. We will tag you where possible unless you specifically ask us not to. If you do not wish any images to be used on social media you must state this to be the case at the time of booking.

Which countries we transfer your personal information to

In order to provide our services, we may need to transfer your personal information to locations outside the jurisdiction in which you provide it or where you are viewing this website for the purposes set out in this privacy policy.  This may entail a transfer of your information from a location within the European Economic Area (the “EEA”) to outside the EEA, or from outside the EEA to a location within the EEA.  Please see ‘Who we share your personal information with’ for more detail on how the information may be shared with Brenda Hudson offices and third-party service providers.

1. We’ll Schedule A Call

Once I receive your contact information we’ll plan to hop on the phone and discuss your upcoming newborn photo session. If this is your first time, don’t worry! I’m here to answer any questions or address concerns you might have about the process. We’ll talk packages, rates, location ideas, and all things baby to make sure you’re comfortable and confident moving forward.

2. I’ll Send You A Booking Agreement

If you’re ready to move forward I’ll send you an electronic booking agreement to sign. This contract, plus a Booking Fee that’s due when we schedule your newborn portrait session, will hold your place on my calendar.

3. Let’s Take Some Photos

I’ll arrive at our photo session location (most likely your home or someplace cozy and private) for a 60-minute newborn session. We want your photos to be natural and candid, and I’ll walk you through the day every step of the way to make sure you and your baby have a great experience.

4. Your Adorable Newborn Portraits Are Ready

I’ll send you your live newborn portrait gallery no later than 2 weeks after our photo session. I’m more than happy to suggest digital prints, albums, or wall art to display your photos. Keep in mind the prints, albums, and wall art will be sold separately from the booking fee for your session.
